A googlin' I will go... (California smoking neighbor lawsuit)

I found several links to neighbors in apartment buildings (not houses) suing over smoke in the stairwells and through the ventilators, mostly not in California.

The newspaper article I saw was specifically addressing smelling smoke in their backyard coming from the neighbors.

I occasionally smell smoke from my neighbors, but 'tain't tobacco ;-)

What about choice? You can refuse to patronize a place that allows smoking. I'm not a smoker, but I find it as offensive as smoke for the government to tell a business how it does business. I find it particularly abhorent for government to tell private clubs what they can or cannot do.

He has, but understand the other side. Does your right to not smoke trump the idiot Rich's right to? Should you be able to infringe on his space and then bitch about? If you had a shred of honest in you, you'd demand that tobacco be outlawed. Fat chance, since it's been replacing other tax increases needed to support the welfare state for the last decade.

There really is no such thing as "separated air spaces" in restaurants. The smoke travels everywhere.Smokers cannot tell,but non-smokers can. I think there are a couple of other factors operating.

(1) Unwillingness of businesses to take risks unless all their competitors have to take the same risk. Restaurants and bars almost always experience an *increase* in income after they go smoke-free. (More people are willing to sit in a room of a fixed size before they start to consider it too crowded.) But no individual restaurant or bar wants to be the first to do it. This is somewhat irrational, but it's part of the way businesses behave.

(In a free market, you'd expect them to partition; have a few smoky restaurants and a larger number of non-smoking ones. But that doesn't seem to be the way any of them want it.)

(2) Employee safety. We agree, in this country, that you cannot subject employees to unnecessary hazards even if you pay them and even if they "voluntarily" chose to work there. In a tight market, people always feel pressure to take jobs that they don't consider entirely satisfactory. That is what led to all sorts of industrial safety scandals about 100 years ago.

Well... If you employ people to be waiters and waitresses and breathe secondhand smoke all day, and they get lung cancer or emphysema, you're in hot water, given the general expectation that employers will not poison their employees.

Of these, I think (2) is a bigger factor than generally realized. No employer wants to be sued for the effects of secondhand smoke on an employee. It's just like any other workplace hazard.

I don't think anybody here has advocated prohibiting people from smoking in their own homes, with no one present who objects.

Ah, "your kind." You're not arguing with anybody who actually exists.

There's increasing evidence that secondhand smoke isn't just unpleasant, it's harmful.

More generally: Do you believe in any restrictions on air pollution (e.g., from industry)? Why or why not?

Around here we have restaurants with separated walled areas with their own A/C systems. But they're fading away... there are fewer and fewer smokers.

One can breathe smoke. It is exactly an issue of being _offended_. It is a control issue.

There is no evidence that second hand smoke is particularly dangerous. Perhaps you should be allowed to drive either. It's just not safe.

The disappointing thing about cigarettes is that they take so long to kill, so smokers aren't efficiently enough eliminated from the gene pool.

So you admit that it's not a healt issue, rather that your sensitive nose is offended.

Show me the statistics of death doue to fires caused my smokers avoiding smoking bans by smoking in restrooms.
