No, it constitutes an accident. If we want people to have cell phones, we'll have to deal with the fact that, in all innocence, some people occasionally forget to turn them off.

What am I among here -- a set of people so perfect that they never make a mistake? Or a set of people so insecure they *claim* to never make mistake?

Normally, engineers have a relatively humble and realistic attitude toward errors. They know they make them and they know they can correct them.

The fact is, the student was insufficiently considerate of his classmates, the teacher and the rules to ensure that his cell phone was off.

Whether that is a crime of sufficient magnitude to nuke him, all his living relatives, his hometown and his girlfriend's dog is a different issue.
