Well, if you had a bit of money and time AND if there was no such provision in the warantee, then sue for performance.
I don't know about in the USA but in the UK it is fairly common for the warrantee to cover the original purchaser and second hand goods are no longer covered (if the manufacturer notices).
Some suppliers are better than others, but this isn't so unusual. That is in part why second hand goods are typically cheaper than brand new.
