The Australian Competition and Consumer Commission alleges warranty rights violations against part retailer MSY.

Amongst serious PC upgraders and hardware tweakers, MSY has a reputation for both unbeatable prices and at times poor service. Following the announcement today that the ACCC has begun legal proceedings against the retailer, it might soon be possible to attach the term 'outright dodgy' as well.

Known as a cut-price national retailer of computer parts, the ACCC alleges that MSY has "made a number of false or misleading representations" in regards to warranty rights. This has happened across multiple stores, on in-store promotional items, and on customer receipts.

I suspect this may have to do with a current campaign by the ACCC against retailers (& wholesalers) who refuse to accept returns of faulty products, directing the purchaser to the product manufacturer instead. Conditions of purchase have often included statements /instructions that the seller has no warranty obligations and that any complaints/enquiries be directed to the manufacturer.

If they're doing this, they're hardly the only ones. If the ACCC are trying to make an example of them, the fines, if any, should reflect that (i.e. be nominal).

It's not as if resources are unavailable to inform people of their true rights, if they can be bothered to find out. In the real world, one only has the rights one's willing to stand up for.

The ACCC would much better spend their resources chasing those who make misleading, or more often than not, outright false, claims about what their product will do, which people are generally much less equipped to form their own judgement about.

**Let's start with religion. If those clowns cannot prove their claims (life after death, miracles, etc), then they should be required to refund the monies paid to them. At the very least, they should be paying tax, like any regular money making concern.

MSY have a sign on there door at the Ultimo store, which is a pig sty, that states something like, if we are busy, we will shut the doors early so we can go home right on store closing time.

My particular concern about that product is that the jury's still out on whether mobile phone radiation is a health risk. If it is, then that product could give people a false sense of security.

**EM radiation is harmful. Length of exposure, frequency and proximity to source, all dictate how much risk there is. Cell 'phones are particularly difficult to quantitfy, risk-wise due to several factors:
  • How people hold the 'phone.
  • Where the antenna is located.
  • How far the 'phone is from the tower, since cell 'phones vary their power output depending on conditions.

The false sense of security given is certainly a possibility, but the promise of 72 virgins, life after death and other nonsensical claims ranks far, far higher in the scheme of evil. Religion's depth and breadth of penetration into the pockets and minds of people is massive. It needs to be curtailed by whatever means necessary. The first step should be to charge parents who inflict religious teachings onto their children with child-abuse.

That opens up a huge can of the proverbial worms.

If the ACCC went through almost any major religion, there would be enough "unprovable" claims to keep the courts busy for many years. I have doubts as to whether many of their followers would participate with the authorities though.

Scientology would be interesting in itself and seems to rake in fortunes.

The other side of the coin is that Churches use services like anyone else such as fire/police etc and other government services.

I switched to using PCDIY after MSY stuffed up a $10000 order I put in. I asked them why they were selling stuff to people that I was waiting on. Their answer was that they would not fill my order until every part of the order was in stock all at the same time. I had order 5 machines and if 3 arrived then they would sell the 3 to someone else. PCDIY have the same prices but better service.
