The phone is only in Asia at the moment, not in Europe where I live, so I don't know of anyone with it to ask, other than these newsgroups.

OK, then I see why you ask in this newsgroup. I believe some Asians read this group. Have you tried asking Motorola for the source code? If they don't provide it with the phone, they must offer it to anybody who asks for it, whether or not the one asking bought one of their phones.

No, they will never need to provide the source for the phone unless they do not know what they are doing.

They have to provide the source for (modified) GPL/LGPL code. ie Kernel and some libraries. But reading about don't they say that they use some distribution?

Sure it only applies to GPL components. But then it also applies to all of them modified or not. Might be, that you won't be able to use it for much without the rest of the system. You cannot know until you see what you get.

What distribution? And what difference would that make anyway?

Yep I think as the phone has Linux on it they have to supply the source code GPL, regardless of any modifications. By the letter of the GPL they only have to do it for the customer, the receipient of the binaries, they don't have to publish to everyone. But I was hoping they would release the work to benefit themselves with the community involvement and vice versa.

They are using MontaVista Linux Consumer Electronics Edition and yes I don't think it does make any difference to the GPL code.

I have written to Motorola, without reply at the mo.

They have to give the source out to anyone who asks: b) Accompany it with a written offer, valid for at least three years, to give any third party, for a charge no more than your cost of physically performing source distribution, a complete machine-readable copy of the corresponding source code, ... Plus they have to accompany the phone with either the source code or the above mentioned written offer. If they don't include this offer, they are in violation of the GPL and have no further rights to use Linux.

The LGPL only requires redistribution to the same user that got the binary, but GPL requires giving it to any third party.

I suppose most of the code simply is an _application_ that is started by the OS. Same is not covered by GPL and thus you are out of luck. Of course some drivers (e.g. for the Keyboard) would need to be GPLed.
