** AFAIK - the suit is not over use of the MP3 compression format as such. ** MP3 is done in software in a PC.Only MP3 decoding is a defined standard.
An MP3 encoder is open to creative (software) design.

A few of the "pods" support the format, so I gather there is a chip that can be used to support it.
