As you may already know, on 16 June 2014 the European Chemicals Agency added 4 new substances to the REACH Candidate List

BOMcheck will be updated to Version 4.3 on 7 July 2014 to include these 4 new REACH Candidate List Substances and also include new substance restrictions in the EU, Norway, Canada and US, and 8 new RoHS exemptions. BOMcheck Version 4.3 will give you expert guidance about these substances to help you to update your Regulatory Compliance Declarations.

BOMcheck was appointed as the UK National Expert for the IEC 62474 standard in June 2012 and took on the role of EMEA regional coordinator in December

2012. The IEC 62474 database of restricted and declarable substances replaces the Joint Industry Guide (JIG). BOMcheck Version 4.3 is completely aligned with the IEC 62474 assessment of these 4 new REACH Candidate List Substances.

New REACH Candidate List Substances

Three of these substances [Cadmium chloride, Sodium perborate; perboric acid, sodium salt and Sodium peroxometaborate)] are not normally found in concentrations > 0.1% w/w in articles (e.g. parts, components, sub-assemblies etc) which are supplied for use in hardware products and electrical and electronic equipment. BOMcheck will automatically update your Regulatory Compliance Declarations for these new substances. The following substance can possibly be found in concentrations > 0.1% w/w in articles (e.g. parts, components, sub-assemblies etc) which are supplied for use in hardware products and electrical and electronic equipment:

1,2-Benzenedicarboxylic acid, dihexyl ester, branched and linear

Possible. There is no reported use of this substance in electrotechnical products. However, the substance is chemically similar to DEHP, DBP, DIBP and BBP, and may be used as a substitute for these phthalates as their use becomes phased out.

IF YOU HAVE CREATED FULL MATERIALS DECLARATIONS ON BOMCHECK THEN YOU WILL NOT NEED TO TAKE ANY ACTION. The Regulatory Compliance Declarations which are generated from your Full Materials Declarations will be updated automatically to take account of these four new REACH Candidate List substances. The Approval Date for these Regulatory Compliance Declarations will be set to 7 July 2014. The Approval Date for your FMD declarations will remain unchanged. If you have created Regulatory Compliance Declarations on BOMcheck then you will need to login to BOMcheck after 7 July and update your parts list declarations for 1,2-Benzenedicarboxylic acid, dihexyl ester, branched and linear, by following the expert guidance provided by BOMcheck.

New substance restrictions in the EU, Norway, Canada and US

From 27 December 2015, any new consumer products sold in Europe must comply with stringent new restrictions in REACH Article 67 on polycyclic aromatic hydrocarbons (PAH) in plastic or rubber materials which come into contact with skin. From 1 June 2014, new restrictions in Norway apply to the manufacture, import, export and sale of consumer products which contain Perfluorooctanoic acid (PFOA) and individual salts and esters of PFOA. From 23 October 2014, new restrictions in Canada prohibit manufacture, advertisement, sale and importation into Canada of products that are made, in whole or in part, of polyurethane foam that contains Tris (2-chloroethyl) phosphate and that are intended for a child under three years of age. There are numerous items of legislation which cover Tris (1,3-dichloro-2-propyl) phosphate (TDCPP), including new restrictions in the US State of Maryland which apply from

1 October 2014. California Proposition 65 requires warning labelling of consumer products before knowingly and intentionally exposing a person to a listed chemical. The EU REACH Candidate List already includes most of the phthalates which are published in the Proposition 65 list, but does not currently include Diisononyl phthalate (DiNP).

8 new RoHS exemptions

On 20 May 2014 the European Commission published 8 new RoHS exemptions which take effect from 9 June 2014:

  • 2 new RoHS exemptions are added to Annex III
  • 6 new RoHS exemptions are added to Annex IV for Medical Devices and Monitoring and Control Instruments

These new exemptions will be available for you to select in BOMcheck from 7 July.
